Labor Law Sexual Harassment

Labor Law Sexual Harassment protects an individual from unpleasant work environments. An individual should have freedom from sex discrimination, which occurs when the action of sexual harassment takes place. Sexual harassment occurs when sexual misconduct of an unwelcome nature occurs as pervasive or severe toward an individual, therefore affecting the working environment, or creating a hostile work environment. Sexual misconduct can occur in many forms, whether it is verbal, physical, or visual and is something that is unwelcome to the individual. Written or verbal harassment occurs when an individual comments on an individuals clothing, body, personal behavior, makes sexual jokes, asks for sexual favors or continuously asks the person out despite them declining. Rumors and sexual innuendoes also fall under this form of sexual harassment. Threatening is another form as well. Physical, involves touching the person in any way that is not wanted. Nonverbal falls under the way a person stares, follows, makes expressions or gestures that are derogatory. Visual sexual harassment involves anything like poster, drawings, emails, which have a sexual connotation.
