The world of sexual harassment cases in the workplace encompasses a large variation of actions, words, language, gestures, and treatment based on sex between men and women. When a woman or man feels uncomfortable due to an uninvited gesture, joke, phrase, or look from another man or woman, he/she is experiencing sexual harassment. These advances must be unwelcomed to be considered sexual harassing. And, this issue of whether the action was welcomed or unwelcomed is the basis of the burden of proof when it comes to cases of sexual harassment in the workplace. If the attorney of the said victim cannot prove the action was unwelcomed, then it cannot be considered sexual harassment. Also, every situation is dealt with on a case by case basis. There is not black and white when it comes to the determination of sexual harassment; every case is different and must be looked at objectively. In the workplace, a victim of sexual harassment can be an employee, supervisor, co-worker, or even an outside vendor of the company.
