Sexual Harassment Cases

Sexual harassment Cases occur when there is a violation of Title VII or Title IX within a work or educational setting. Both types of cases differ in that Title VII deals with cases within the workplace and has to do with sexual discrimination as a result of sexual harassment which is in violation of VII. In a work environment, sexual harassment deals with unwelcome sexual advances by another employee or someone of authority. Sexual harassment may take the form of verbal, physical, or visual. Sexual Harassment Cases filed under Title IX involves the educational environment. The form of sexual harassment must be so severe or pervasive that it causes the student to be deprived of their right to education or benefits. The school must have deliberate indifference to the situation when it occurs, meaning that they do not take action on the reported violation, although they know about it.
