Sexual Harassment And Law

Sexual Harassment and Law is a broad subject that has undergone radical changes over the past sixty odd years. Prior to the enactment of Title VII of the Civil Rights Act, sexual harassment was not defined and instances of sexual harassing were not considered to be unlawful. However, Title VII declared that employment discrimination on the basis of race, color, religion, national origin, or sex is prohibited. Although there is no mention of the term sexual harassment in the Civil Rights Act, sexual harassment was later found to be a form of sexual discrimination. Through various important court cases, the definition of what precisely sexual harassment is under the law has changed. In 1981 harassment that created what could be called a "sexually hostile environment" was added to the definition. In 1985, physical violence that occurs on the basis of the victim's gender, even when it does not involve sexual conduct, was also ruled to be a form of sexual harassment.
